New Delhi, November 19, 2023 - In a recent development in the Delhi Excise Policy case, the Rouse Avenue court has decided to extend the judicial custody of Manish Sisodia until November 22. The court has also made arrangements for counsels to examine unrelied documents related to the case at the CBI Headquarters.
The court postponed the CBI case concerning the Delhi excise policy to November 22 and, in line with this decision, extended Manish Sisodia's judicial custody until the next hearing date. This decision was handed down by Special Judge M. K. Nagpal.
To facilitate the examination of documents, the court has instructed the counsels to visit the CBI office between 2 PM and 7 PM on every working day. The schedule for this examination has been designed to accommodate the convenience of the counsels. Furthermore, the court has directed the counsels to send their inspection requests to the Investigating Officer via email, after which the IO will arrange a suitable time for the document review.
Additionally, the court has ordered the CBI to provide hard copies of the second supplementary charge sheet to one of the accused and to supply the soft copy of the second charge sheet to some of the other accused individuals involved in the case.
It's important to note that the IO has asserted that copies of all the charge sheets and related documents, as well as the deficient documents, have already been provided. However, the counsel for one of the accused argued that the soft copy of the supplementary charge sheet has not been supplied, and another counsel mentioned the absence of the hard copy of the second supplementary charge sheet. In response, the IO assured the court that these documents would be supplied within a week, and he also mentioned that a list of unrelied documents had been shared with the counsels via email.
In further proceedings, the court directed the CBI to furnish a list of Un-Relied Documents (URD) to the counsel. During the course of these interactions, one of the counsels returned the documents, stating that they were not properly paginated.
In light of these developments, the court emphasized the importance of allowing accused persons to inspect the URD, citing a Delhi High Court judgment that upholds this right. The court has directed the counsel to send a written request to the Investigating Officer via email within a week, after which the IO will arrange a suitable schedule for the inspection.
