New Delhi:  The Rouse Avenue court postponed its decision on whether to hear Manish Sisodia's regular bail application due to his pending curative petition before the Supreme Court. Judge M K Nagpal set the date for the decision on February 21. The Enforcement Directorate (ED) argued against Sisodia's bail plea, citing his ongoing curative petition at the apex court. According to the agency, allowing the bail application while the curative petition is pending would be duplicative.

Special Counsel for the ED, Zoheb Hossain, contended that seeking the same relief in two different forums simultaneously is legally improper. He emphasized that the trial court should wait for the curative petition's outcome before considering Sisodia's bail plea. However, senior advocate Mohit Mathur, representing Sisodia, countered this argument, questioning the rationale behind delaying the trial pending the curative petition's resolution.

Mathur highlighted previous instances, such as the coal scam cases, where similar legal remedies were sought. In those cases, trial proceedings continued despite the pending special leave petition (SLP) in the Supreme Court. He noted that while the SLP remained undecided, the trial proceeded. Additionally, Mathur pointed out that Sisodia's previous bail applications, including those at the Supreme Court, were rejected. Despite this, Sisodia has submitted another bail plea before the trial court.
