New Delhi: The Indian National Congress (INC) Party has taken legal action by moving the Delhi High Court against an order from the Income Tax Department, which initiated assessment proceedings for three years. The plea was presented by the INC's lawyer before a bench led by Acting Chief Justice Manmohan, along with Justice Manmeet Pritam Singh Arora, requesting an urgent listing for the following day.
Representing the INC, lawyer Prasanna S stated that reassessment proceedings have begun against the Indian National Congress party for a span of three years. After considering the arguments, the bench scheduled the hearing for March 20, 2024. Recently, the Delhi High Court upheld the Income Tax Appellate Tribunal (ITAT) order, which declined to stay the Income Tax notice for the recovery of over Rs 105 crore as outstanding tax against the INC. While affirming the ITAT order, the Court granted the Congress party the liberty to approach the Appellate Tribunal again with their grievance.
The Congress has also taken recourse to the Income Tax Appellate Tribunal (ITAT) against the recovery, filing a complaint and seeking a stay on the Income Tax Department's recovery proceedings and the freezing of their bank accounts. In their complaint, Congress highlighted that the Income Tax Department enforced its regulations by seizing some bank balances without awaiting the outcome of the scheduled hearing. The Congress appealed for the department to refrain from further actions until the stay application is resolved.
