The Supreme Court heard the case of rape and murder of a trainee female doctor at RG Kar Medical College in Kolkata on 20 August 2024. During this, the Supreme Court expressed serious concern about this incident and made strong comments on the negligence of the state government and the police.
The Supreme Court said that a major incident took place at RG Kar Medical College on the night of 15 August when a protest was going on against the rape and murder of a female trainee doctor. During this, about seven thousand people attacked the hospital. Chief Justice D.Y. Chandrachud asked that despite such a big incident, how can the state government and the police remain unaware of it?
A bench of CJI DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Mishra heard the case. Senior advocate Kapil Sibal presented his arguments in the court on behalf of the Mamta Banerjee government. Sibal said that at the time of the incident, 150 policemen were deployed outside the hospital, but when more than seven thousand people started attacking, more force was needed. However, by the time more force arrived, the incident had already happened.
On this argument of Kapil Sibal, CJI Chandrachud said, "This is a very serious matter. 37 people have been arrested and they have been identified from CCTV footage." He raised the question that how can the state government be unaware of the fact that when such a big demonstration is taking place, there can be another side which will come and try to stop it?
CJI said that the mob attacked the male and female doctors in a planned manner. He informed that the lawyer appearing on behalf of the female doctors, Aparajita Singh, presented the entire incident before the court, referring to an email. In this email, it was told that about 700 doctors used to live in RG Kar Medical College, but after this incident, only 100 doctors are left there, the rest of the doctors have left the college for security reasons. The Supreme Court has directed the state government to take immediate measures for the safety of doctors and ensure that such incidents do not happen again. Considering this matter as very sensitive and serious, the court stressed the need for the state government to take strict action on this.
