In a recent development, the Bombay High Court has recommended setting up a committee to create Standard Operating Procedures (SOPs) for handling sexual assault cases involving minors. This initiative aims to enhance the effectiveness of police, hospitals, and schools in addressing such cases. Proposed Committee Members During the hearing of the Badlapur minors’ sexual assault case, the court suggested including retired IPS officer Meera Borwankar, former Bombay High Court Judge Sadhana Jadhav, and Shalini Phasalkar Joshi in the committee. This recommendation comes as a response to issues noted with the current application of the Protection of Children from Sexual Offences (POCSO) Act. Court's Concerns and Recommendations The court expressed frustration with the investigation’s documentation, criticizing it for being formulaic and lacking depth. Justice Chavan questioned the repetitive nature of the case diary, stating that it fails to meet its intended purpose. He emphasized the need for a thorough and accurate reflection of investigative steps and efforts to apprehend the suspects. The court also addressed concerns related to the forensic department, acknowledging a backlog and ongoing efforts to fill vacant positions. Regarding the Test Identification Parade (TIP), it was noted that another FIR had been filed, and the court underscored the need for sensitivity towards victims and their families. Previously, on August 31, a Thane Court had approved the TIP request for the Badlapur case. The parade, conducted in the presence of an Executive Magistrate, saw the victims identify the accused. The case involves the alleged assault of two four-year-olds in their school in Badlapur, Maharashtra. The Special Investigating Team (SIT) has since prepared a psychological profile of the accused to support the investigation.
